Collaborative Law: A Peaceful Approach to Divorce

Divorce can feel overwhelming, but it does not have to be contentious. Collaborative law is designed to help couples separate in a way that benefits both parties while preserving peace throughout the process. In this approach, each spouse hires their own attorney, and the parties’ attorneys work together with the spouses to create an amicable agreement for everyone involved.

Your Role in Collaborative Law

Unlike litigation, where the judge controls the outcome, collaborative law empowers you to take control. You, your spouse, and your respective lawyers manage the outcome of the divorce.

At SPM Law, our attorneys will advocate for you in resolving all issues related to property division, alimony, child custody, and support, empowering you to work towards an agreement that meets your unique needs.

How Does Collaborative Law Work?

At the beginning of the collaborative process, spouses and their lawyers sign a participation agreement during the initial meeting to confirm their acceptance of the collaborative law process. This agreement requires both spouses to be transparent and share all financial information, as well as relevant supporting documents.

Following the initial meeting, a series of joint sessions is held, attended by spouses, attorneys, and any other hired professionals such as coaches, financial specialists, accountants, and appraisers. These sessions focus on discussing issues and shared goals, with all parties working together to reach an agreement that benefits both spouses and affected family members. If an agreement is reached and approved, it becomes a legally binding document.

If the parties cannot reach an agreement or if either spouse decides not to continue or opts to go to court instead, the collaborative process ends immediately. If this occurs, both lawyers will automatically terminate their contracts with their clients, and both spouses will need to find new family law attorneys.

What Are the Benefits of Collaborative Law?

Collaborative law offers a practical approach that can help individuals avoid expensive litigation fees and prevent the case from becoming adversarial. What’s the difference between collaborative law and mediation? Unlike in mediation, each spouse has their own attorney to confide in and advocate for them. Collaborative law allows individuals to:

  • Ensure all details and discussions of the divorce remain confidential
  • Expedite the process and avoid lengthy litigation
  • Minimize conflict by avoiding contentious courtroom proceedings
  • Customize the terms of the divorce and structure the settlement in a way that works best for their family

Collaborative law benefits couples considering separation or divorce, and it is also helpful for parents jointly deciding the child custody schedule for their children. By choosing collaborative law, you select a process designed to be as amicable and neutral as possible, giving you confidence in making the right decision for your family.
